Proceedings for a contempt of court under the strict liability rule (other than Scottish proceedings) shall not be instituted except by or with the consent of the Attorney General or on the motion.

Contempt of Court Act The complexity of fraud trials with evidence concerning complicated financial transactions and tracing of money, requiring knowledge of accounts and accounting practices, and share dealings and complicated methods of cheating. Yet the jurors in these trials will not have been subject to even a literacy test.

Though the Contempt of Court Act, 1952 and 1971 have since repealed many of the stifling provisions of the pre-independence act, some lacunae remain in the law. The Law of Contempt of Court has to balance the Freedom of right to speech and expression granted to the citizens of India as well as the provisions made to enable the judicial system to function without obstruction of any kind.

The essential points of the Attorney General’s case, framed within the definitions of the Contempt of Court Act 1981 were that: proceedings were active from the time Mr Jefferies had been arrested.

Section 10 Contempt of Court Act 1981. Section 10 provides some protection for journalists and their sources. It states that no court shall require anyone to disclose a source of information.

The concept of contempt is of English origin and is found only in countries that follow the common-law system. The primary importance of the notion of contempt is that it warrants judicial action in defense of the judicial or legislative power itself.

THE CONTEMPT OF COURT ACT 1981 1. Introduction THIS Act reforms certain aspects of the law concerning contempt of court. Pleas for reform have been made regularly for many years. The JUSTICE report on Contempt of Court was published in 1959. Some of its recommendations were implemented.' Some of the rest are echoed in this Act.

No court may require a person to disclose, nor is any person guilty of contempt of court for refusing to disclose, the source of information contained in a publication for which he is responsible, unless it be established to the satisfaction of the court that disclosure is necessary in the interests of justice or national security or for the prevention of disorder or crime.

Therefore it was replaced by Contempt of Court Act, 1952.But the Act of 1952 was again replaced by Contempt of Court Act, 1971 on the recommendations of the committee headed by H. N Sanyal. This was done because of the dissatisfactory, uncertain and undefined nature of Contempt of Court Act, 1952.
